Consumer Protection Make the debt collectors pay you!

Fair Debt Collection Practices Act (FDCPA) is a list of rules that debt collectors must follow when communicating with consumers. If they violate these rules, then the consumer can be awarded up to $1,000. It is important that you make a record of every call that is made and keep every letter you receive. Collectors can’t call you before 8:00 A.M. or after 9:00 P.M. They can’t call you at work or any one else’s phone without your permission. They can’t threaten you with garnishment of your wages, taxes, or bank accounts without first getting a court ordered judgment against you. The Telephone Consumer Act (TCPA) is a list of rules that telemarketers and debt collectors must follow when communicating with consumers. If they violate these rules, they will have to pay the consumer $500.00 to $1,500.00 per violation. Write down all they say and what action you took. You can download a call log to help you here.

If you do not want to receive these calls, then it is important that you never supply your number to them or agree that they have called a good number. If you have already supplied your number, then tell them that you revoke your consent and the calls must stop. Press the button to “opt out” of future calls. Most importantly, make a written record of all the calls you receive and what action you took, whether you answer them or not.

The Fair Credit Reporting Act (FCRA) regulates what your creditors can report about you to the credit reporting agencies. If you are denied for credit or denied the best rate of credit, then you should request that creditor to provide you a copy of the credit report it based the decision on. They are required to give you a copy of your credit report if they have denied you credit.

The Hawaii Unfair and Deceptive Practices Act (HUDAP) provides additional remedies for a violation of the FDCPA, TCPA, FCRA, and other state or federal laws when the consumer has incurred actual damages. TThe HUDAP also protects you when you buy an automobile from a dealership and don’t receive your title within 30 days.
